This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. This work empirically tests the concept of the ‘whistleblowing triangle,’ which is modeled on the three factors encapsulated by the fraud triangle (pressure or financial incentives, opportunity and rationalization), in the Indonesian context. Anchored in the proposition of an original research framework on the whistleblowing triangle and derived hypotheses, this work aims to expand the body of knowledge on this topic by providing empirical evidence. The sample used is taken from audit firms affiliated with both the big 4 and non-big (...) 4 companies operating in Indonesia. The results of analysis using the PLS-PM method found a significant relationship between the components of the whistleblowing triangle and the intention of blowing the whistle. We found that financial incentives are the most significant predictor of auditors’ intention to blow the whistle in Indonesia. Other components, such as opportunity and rationalization, also play an important role in supporting auditors’ intention to blow the whistle. Our findings also suggest that related pressures are the top priority for audit firms in Indonesia to consider in increasing whistleblowing intention. We expand the previous literature on whistleblowing which has been derived from the components of the fraud triangle (Brown et al. in Account Public Interest 16(1):28–56, 2016; Smaili and Arroyo in J Bus Ethics, 10.1007/s10551-017-3663-7, 2017) by adding empirical evidence. In this paper I explain the impact of phenomenological philosophy in the conceptions of Luís Cabral de Mancada about law and juridical experience. Stressing that Moncada was the first scholar in Portugal who made an extensive use of phenomenological doctrines within his own field of research, I show that Husserl, Hartmann, and Scheler were the most influential thinkers for him. In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. In this paper, I analyze Carlos Cossio’s theory of law, and how his theory was a reaction to Kelsen’s juridical positivism. The most important aspect I highlight is the logical abstract normativism defended by Kelsen, and how it was overcome by a transcendental and existential theory of law, which Cossio develops in a close relationship to Husserl and Heidegger views.

The justification of Natural Law is a very controversial issue, not only after the Positivist’s rebuttals, but since its very anthropological foundations in the early modern age. In this paper, I try do give an account of Natural Law and natural rights in terms of a phenomenological description of the background of normative intentionality. Taking a genetic stance, I go from the positive norm and the intentionality that constitutes it to the underling pregiveness that supplies the condition of its possibility. (...) I exhibit it as the experience of the live-world, and I analyze it as an intersubjective world, where persons are given as equals and worth-counting. This is the very root of the concept of human dignity. Starting from it, I develop an account of the sense and content of the concept of Human Rights as a set of eidetic laws creating the framework for authentic human relationships. (shrink)

Os pressupostos teóricos de Ilya Prigogine e a epistemologia crítica – um diálogo de convergências? Resumo: Ter clareza das raízes epistemológicas dos referenciais teóricos utilizados nas pesquisas científicas é primordial para que essas investigações tenham veracidade. Entretanto, alguns autores, por diversos motivos, não explicitam tais informações em suas obras. Surge então a necessidade de se saber onde Ilya Prigogine - físico-químico e filósofo que refletiu sobre a função do tempo, do conhecimento e das leis fundamentais que governam o universo - (...) está epistemologicamente posicionado. Desta forma, a presente investigação buscou analisar, comparar e conectar as perspectivas da epistemologia crítica, uma das mais importantes vertentes da filosofia contemporânea, com as proposições teóricas de Prigogine, buscando encontrar conexões entre elas. Desta pesquisa exploratória de cunho bibliográfico, emergiram da análise de conteúdo as seguintes categorias: conhecimento, história, natureza, utilização e ciências exatas x humanas. Subsidiados pelas discussões aqui construídas, conseguimos constatar que existem intensas convergências entre a epistemologia crítica e a obra de Prigogine. Com isso, confirmamos que o entrelaçamento entre Prigogine e a epistemologia crítica é forte o suficiente para posicioná-lo como epistemólogo com vertente crítica. O arcabouço teórico aqui desenvolvido pode ser utilizado para justificar a utilização das ideias prigoginianas em trabalhos de orientação progressista e também abre espaço para novas pesquisas sobre o posicionamento epistemológico de Prigogine. Abstract: Having clarity on the epistemological roots of the theoretical frameworks used in scientific research is paramount for these investigations to be true. However, some authors, for various reasons, do not explain the information in their works. The need then arises to know where Ilya Prigogine - physicist-chemist and philosopher who reflected on a function of time, knowledge and the fundamental principles that govern the universe - is epistemologically positioned. In this way, the present research sought to analyze, compare and connect with the perspectives of critical epistemology, one of the most important aspects of contemporary philosophy, with Progogine's theoretical proposals, seeking to find connections between them. From this exploratory research of a bibliographic nature, content analysis emerged as the following categories: knowledge, history, nature, use and exact x human. Supported by the discussions built here, he was able to verify that there are intense convergences between a critical epistemology and a work by Prigogine. With this, we confirm that the intertwining between Prigogine and a critical epistemology is strong or sufficient to position him as an epistemologist with critical criticism. The theoretical framework developed here can be used to justify the use of Prigoginian ideas in works of progressive orientation and also opens space for new research on Prigogine's epistemological positioning. Sin embargo, algunos autores, por diversas razones, no hacen explícita esta información en sus trabajos. Entonces surge la necesidad de saber dónde está posicionado epistemológicamente Ilya Prigogine, físico-químico y filósofo que reflexionó sobre una función del tiempo, el conocimiento y los principios fundamentales que gobiernan el universo. De esta forma, la presente investigación buscó analizar, comparar y conectar con las perspectivas de la epistemología crítica, uno de los aspectos más importantes de la filosofía contemporánea, con las propuestas teóricas de Progogine, buscando encontrar conexiones entre ellas. En esta investigación exploratoria de naturaleza bibliográfica, surgieron las siguientes categorías del análisis de contenido: conocimiento, historia, naturaleza, uso y ciencias humanas exactas. Subsidiado por las discusiones construidas aquí, pudo verificar que hay intensas convergencias entre una epistemología crítica y un trabajo de Prigogine. This paper aims to analyse a set of communicative events within the service encounter genre in tourism and leisure interdiscursive domains as displayed in course books on professional communication in English (commonly pointing to ESP). These supposedly replicate interaction in real life settings. Therefore, it is relevant to uncover the ways authentic interactions can be interpreted in the pedagogical setting of workplace conversation from a discursive and pragmatic perspective. More specifically, this empirical and exploratory study discusses ways of improving rapport (...) management skills in interpersonal and intercultural communication, in general, and in professional interaction, in particular, in a selection of excerpts on greeting / asking for info exchanges. The study uncovers participants’ possible co-constructions of civility and politeness strategies in naturally occurring classroom discourse supported by course materials in English for glocal communication across segments in the tourism domain as object of this study. Public decisions concerning large projects with detrimental environmental or heritage impacts involve value conflicts which stem from the diverse interests and variety of ways of evaluating the costs and benefits of such projects. They are also framed by institutionalised procedures and practices which favour certain concerns to the detriment of others. This paper aims to contribute towards a better understanding of how these procedures and practices, namely decision support tools such as the Environmental Impact Assessment (EIA), tend to shape public (...) decision-making processes in particular ways. It draws on a study of the public controversy surrounding the Foz Tua dam in Portugal, with a focus on the values upheld by the different parties in the controversy and their interplay in the production of justifications, specifically the actors’ positions on values and value conflicts and the restrictions posed by institutionalised public decision-making procedures on the expression and consideration of certain values. O texto tem o objetivo de apresentar como o filósofo francês Gilles Deleuze, a partir da obra Nietzsche e a Filosofia, interpreta a Genealogia da Moral, obra escrita pelo filósofo alemão Friedrich Nietzsche, levando em consideração as formas mais gerais do niilismo: ressentimento, má consciência e ideal ascético.

Objetivou-se estratificar fatores de risco para doenças cardiovasculares (DCV) em dez anos em jogadores de basquetebol em cadeiras de rodas. O percentual de risco cardiovascular foi estratificado pelos escores de Framingham (ERF) e de Risco Global (ERG). Dos treze jogadores avaliados, 38,46% apresentava sobrepeso e obesidade e 77%, alterações na porcentagem de gordura corporal e na circunferência abdominal. O ERF identificou 15,38% dos jogadores com risco intermediário para desenvolvimento de DCV e pelo ERG, 15,4% dos homens apresentava risco intermediário, 7,7% (...) alto risco por diabetes e 7,7% muito alto risco por doenças ateroscleróticas. Os resultados de composição corporal demonstram uma predisposição para desenvolvimento de DCV, sendo que o ERG identificou indivíduos com alto risco e muito alto risco. Conclui-se que a identificação dos fatores de risco é útil para que ocorra uma maior prevenção das DCV e aconselhamento adequado sobre adoção de hábitos de vida saudáveis por esses indivíduos. This paper is a research study of an interdisciplinary and exploratory kind drawing on a case study undertaken in elementary classrooms in socio-economically disadvantaged areas of Santiago de Chile. Having combined Linguistics for Education Studies and Corpus Linguistics approaches, the analysis of pragmalinguistic choices (i.e. personal pronouns, other lexical choices marking in-group relations) used in the introductory parts in a corpus of 50 lessons recorded in an elementary school setting there comes to be a key strategy for teachers' and learners' (...) involvement in classroom interaction The pragmalinguistic strategies evidenced in teachers' and learners' output have come to confirm the role of communicative strategies to promote participants' engagement in the teaching/learning process. In other words, teachers create an in-group relation, a solid sense of belonging and empathy among the participants in the teaching-learning context from the opening communicative stances in use to overcome less advantaged home and community cultural settings. The research findings also point to further studies to devise pedagogic tools addressing the specific contexts under scrutiny. Thus, a Teacher-Learner rapport is conveyed primarily through teachers' language choice, which is seen as the main force for learners' engagement in disadvantaged settings. (shrink)

Utilizando-se do método fenomenológico, Scheler afirma que a ética deve basear-se na experiência, pois o valor não é algo que se atribui, mas que é experimentado. O fenomenólogo alemão defende que o homem está rodeado por um cosmos de valores que não necessita ser produzido, apenas reconhecido através do perceber sentimental, possibilitando, inclusive, uma organização hierárquica dos valores. No entanto, este perceber se encontra afetado (...) pelo ressentimento, o que implica em uma negação dos valores através da inversão valorativa. (shrink)

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. Este artigo tem como principal objetivo analisar e discutir questões acerca de como à educação muitas vezes acaba por contribuir para o aumento das desigualdades sociais. Desse modo, através dessa análise pretende-se ainda destacar as contribuições e críticas do pensamento de Pierre Félix Bourdieu, Paul- Michel Foucault e Karl Marx sobre os problemas sociais que permeiam a sociedade desde o século XIX até os dias atuais e muitas vezes são fortalecidos pelos sistemas educacionais.

Este artigo apresenta a potência do pensamento da filósofa e professora Ada Kroef para o ensino de Filosofia e a Educação. Para tanto, abordaremos os livros Currículo-nômade: sobrevoos de bruxas e travessias de piratas Inspirada pela Filosofia da Diferença (2018) e Escola como polo cultural: contornos mutantes em fronteiras fixas (2017). Nessas obras, a autora questiona teorias e práticas conservadoras do ensino e da educação de forma geral, propondo a criação de novas práticas e posicionamentos teóricos. A estrutura desse artigo (...) se desenvolve em dois tópicos. O primeiro, A Escola na Filosofia, pensa essa instituição a partir das noções de currículo-nômade e currículo-programa. O segundo, A Filosofia na Escola, pondera sobre o fazer dos professores de Filosofia nas diversas funções que podem ocupar na escola e em políticas públicas educacionais e também sobre a prática docente de Ada Kroef como professora no curso de Filosofia da UFC nas disciplinas de estágio supervisionado, onde cria estratégias pedagógicas diferenciadas na experiência do Sábado Filosófico. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Whistleblowers who need to decide whether or not they should report wrongdoing usually experience several anxieties and pressures before making a final decision. As whistleblowers continue to attract the attention of a wide range of stakeholders, more research is necessary to understand the effects of the perceived seriousness of threats and perceived seriousness of wrongdoing, as well as the effect of the rationalization process on the intention to blow the whistle. We make the original proposal that the rationalization process can (...) affect how PST and PSW trigger whistleblowing intentions. We tested our model using employees of tax offices operating in an emerging economy. We suggest several research findings, which can be summarized as follows: PST reduces individuals’ intention to blow the whistle. That is, the greater the threat perceived by whistleblowers, the higher the likelihood they will choose to remain silent; we find evidence of a positive relationship between PSW and whistleblowing intention, whereby PSW increases individuals’ intention to blow the whistle. That is, the more serious the wrongdoing perceived by potential whistleblowers, the more likely they are to choose to blow the whistle; and we find evidence of the important role of rationalization in moderating the relationships between PST, PSW, and whistleblowing intention. The implications of these findings for business ethics scholars, managers, and end-users interested in whistleblowing are also presented. (shrink)

ABSTRACT Inspired by the concept used in the “tattoo scene” of blast over, which designates the use of spaces between tattoos to add others, without hiding or disguising the previous ones, we propose an exercise of analysis of an artist’s book, Coração com Estrela-do-mar Dentro [Heart with Starfish Inside] by Filipe Homem Fonseca (2019). The concept emerged from one of the pages of the book to become a target of questions of literary reading, from a pragmatic perspective as well. The (...) proposal will follow a route: enter the text through the book-object that gives an important place to the illustration, by death_by_pinscher, remove it from there and then include it again to make the global reading, in order to also enhance the appeal of the potential young reader to the text. This study aims to examine the ethical decision-making model proposed by Schwartz, where we consider the factors of non-rationality and aspects that affect ethical judgments of auditors to make the decision to blow the whistle. In this paper, we argue that the intention of whistleblowing depends on ethical awareness and ethical judgment as well as there is a mediation–moderation due to emotion and perceived moral intensity of auditors. Data were collected using an online survey with 162 external auditors who worked (...) on audit firms in Indonesia as well as 173 internal auditors working in the manufacturing and financial services. The result of multigroup analysis shows that emotion can mediate the relationship between EAW and EJW. The nature of this relationship is more complex and then tested by adding moderating variables using consistent partial least squares approach. We found that EMT and PMI can improve the relationship between ethical judgments and whistleblowing intentions. These findings indicate that internal auditors are more likely to blow the whistle than external auditors; and reporting wrongdoing internally and anonymously are the preferred way of professional accountants to blow the whistle in Indonesia. This work empirically tests the concept of the ‘whistleblowing triangle,’ which is modeled on the three factors encapsulated by the fraud triangle, in the Indonesian context. Anchored in the proposition of an original research framework on the whistleblowing triangle and derived hypotheses, this work aims to expand the body of knowledge on this topic by providing empirical evidence. The sample used is taken from audit firms affiliated with both the big 4 and non-big 4 companies operating in Indonesia. The results (...) of analysis using the PLS-PM method found a significant relationship between the components of the whistleblowing triangle and the intention of blowing the whistle. We found that financial incentives are the most significant predictor of auditors’ intention to blow the whistle in Indonesia. Other components, such as opportunity and rationalization, also play an important role in supporting auditors’ intention to blow the whistle. Our findings also suggest that related pressures are the top priority for audit firms in Indonesia to consider in increasing whistleblowing intention. We expand the previous literature on whistleblowing which has been derived from the components of the fraud triangle :28–56, 2016; Smaili and Arroyo in J Bus Ethics, https://doi.org/10.1007/s10551-017-3663-7, 2017) by adding empirical evidence. This article originally advances the field of organizational whistleblowing by empirically investigating the suitability of the four elements of the fraud diamond as a means to understand the intention to disclose wrongdoing through virtual channels. This article also makes a contribution on the theme of whistleblowing as it relates to customers, an under-studied, however, relevant stakeholder in this field. The main findings of the article are as follows: the four elements of the fraud diamond as they relate to whistleblowing—a combination (...) of pressure, financial incentive, opportunity and rationalization, and capability—can explain the intentions behind customer reports of wrongdoing; online social media channels are customers’ preferred means of whistleblowing; the elements of opportunity and capability are strongly correlated with the use of social media as a method of disclosing wrongdoing; and virtual channels can be useful for whistleblowers in order to avoid potential retaliation. Unique managerial and academic implications of these research findings are also discussed, extending the layers of knowledge on whistleblowing in organizations. (shrink)

Este texto propõe um conceito que melhor ajude os que nelas trabalham a escolher as obras literárias que se leem e dão a ler: o design literário. Concentramo-nos nas obras que se reúnem no subsistema literário infantojuvenil (LIJ), em particular nos livros que subalternizam o código ver­bal, mantendo o valor que interessa para desenvolver o gosto e as competências para a leitura de literatura: é o livro-objeto, o (...) que desafia os limites da investigação em estudos literários, mas que julgamos importante para discutir a literariedade na sociedade contemporânea que se pretenda democrática no acesso à leitura literária para além do consumo de livros. Esta perspetiva pode ser considerada uma desvalorização do literário pela valorização do utilitário, o que contrariaremos. (shrink)

O presente artigo busca articular reflexões a partir da teoria da interseccionalidade. Nesse campo, a questão da liberdade é um ponto importante e é antípoda do racismo. A forma pela qual as mulheres negras afirmam a liberdade, individual ou coletivamente, produz resultados políticos e sociais. Neste artigo buscamos analisar a percepção da liberdade no cotidiano. Foram entrevistadas mulheres negras de diferentes níveis de escolaridade, em idade reprodutiva, residentes do sudoeste baiano. A liberdade se apresenta como uma possibilidade que advém de (...) conquistas econômicas e sociais. É, nesse sentido, resultante de lutas coletivas e sociais. O racismo é, então, uma barreira importante a ser considerada a partir da teoria da interseccionalidade. A estruturação de sentidos e significados construídos nas narrativas do cotidiano pode auxiliar na compreensão das condições sociais e de vida das mulheres negras e orientar hipóteses de pesquisa e de ação política. Whistleblowers have significantly shaped the state of contemporary society; in this context, this research sheds light on a persistently neglected research area: what are the key determinants of whistleblowing within government agencies? Taking a unique methodological approach, we combine evidence from two pieces of fieldwork, conducted using both primary and secondary data from the US and Indonesia. In Study 1, we use a large-scale survey conducted by the US Merit Systems Protection Board (MSPB). Additional tests are conducted in Study 1, (...) making comparisons between those who have and those who do not have whistleblowing experience. In Study 2, we replicate the survey conducted by the MSPB, using empirical data collected in Indonesia. We find a mixture of corroboration of previous results and unexpected findings between the two samples (US and Indonesia). The most relevant result is that perceived organizational protection has a significant positive effect on whistleblowing intention in the US sample, but a similar result was not found in the Indonesian sample. We argue that this difference is potentially due to the weakness of whistleblowing protection in Indonesia, which opens avenues for further understanding the role of societal cultures in protecting whistleblowers around the globe. The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives.
